Terms and Conditions of Hire
1. Interpretation
1.1 Definitions
In these Terms and Conditions:

"Contract" – the agreement between you and us for the hire of goods, including these terms.

"Force Majeure" – events outside reasonable control, such as natural disasters, strikes, terrorism, and similar.

"Hire Goods" – any equipment, tools, or accessories hired to you.

"Hire Period" – the time from when you take possession of the Hire Goods until we receive them back.

"Liability" – all forms of legal responsibility for losses or damages.

"Rental" – the hire charges for the goods.

"Services" – any services we provide, such as delivery and collection.
2. Basis of the Contract
2.1 All hires are subject to availability. We are not liable if goods are unavailable due to circumstances beyond our control.
2.2 If you are an individual, the hire term will not exceed 3 months and is outside the scope of the Consumer Credit Act 1974.
2.3 These terms do not override your statutory consumer rights. Any terms marked with (*) may be unenforceable if you are a consumer. Contact your local Trading Standards or Citizens Advice for more information.
3. Payment
3.1 Charges will be as quoted or listed in our current price list.
3.2 All amounts payable must be made as agreed. Prices exclude VAT unless stated otherwise.
3.3 Timely payment is essential. Payments are only considered made when cleared funds are received.
3.4* Late payments may incur interest at 4% above NatWest's base rate or the statutory rate, whichever is higher. Interest is compounded quarterly.
3.5* No deductions or set-offs are permitted.
4. Risk, Ownership & Insurance
4.1–4.3 Risk transfers to you upon delivery. It remains with you until we regain physical possession. Ownership always remains with us.
4.4 You may not sell, mortgage, pledge, or otherwise deal with the goods.
4.5 We may offer insurance at an additional cost or require you to insure the goods. Proceeds from any insurance claim must be held on trust for us.
5. Delivery & Services
5.1 If we provide Services (e.g., setup), those involved are considered your agents. You are responsible for directing them unless they are negligent.
6. Your Responsibilities for Hire Goods
6.1 You Must:

Not tamper with the goods and use them only for their intended purpose.

Notify us of any damage, breakdown, or loss immediately.

Protect the goods from theft, damage, or misuse.

Notify us if your address changes and allow inspections when requested.

Keep the goods in the UK unless we consent in writing.

Conduct legally required checks unless we’ve agreed to do them.

Ensure proper use of fuel, oil, and voltage.

Make sure operators are trained and qualified.
6.2 Return goods in clean and good condition, with all documentation.
7. Breakdown
7.1 If a breakdown is due to fair wear or an inherent fault, we will adjust your Rental accordingly.
7.2–7.3 You are liable for damage due to misuse. We cover routine maintenance and repairs from fair wear and tear.
7.4 Do not attempt repairs without our written consent.
8. Loss or Damage
8.1–8.2 You are responsible for repair or replacement costs (less any insurance proceeds) if goods are returned damaged or lost.
8.3 If goods are lost/damaged beyond repair, you must pay Rental until reported and liquidated damages (2/3 of Rental) until we replace them.
9. Termination by Notice
9.1 Fixed-term hires can’t be ended early unless agreed.
9.2–9.3 For flexible hires, either party may terminate with agreed notice or, if not agreed, you by returning the goods, or us by giving 14 days’ notice.
10. Default
10.1 Events of Default Include:

Failure to pay on time.

Breach of terms not remedied within 14 days.

Misleading information or insolvency actions.

Negative changes to your financial position.
10.2 Our Rights on Default:
-
Repossess goods.
-
Suspend or cancel Services or Contracts.

Demand immediate payment of all sums.*
10.3–10.4 Repossession does not affect our right to damages. On termination, you must return goods and settle all outstanding payments.
11. Limitations of Liability
11.1–11.3* All implied warranties are excluded where legally allowed. Liability for property damage is limited to replacement cost.
11.4–11.5* No liability if payment is overdue or you continue using damaged goods.
11.6–11.7 You must allow us a chance to fix problems before incurring costs.
11.8–11.9* We are not liable for:

Consequential or economic loss.

Business interruption.
-
More than 5x Rental value or £1,000 (unless insurance extends it).
11.10 These limitations apply separately to breach of contract, tort (including negligence), and statutory duties.
11.11 We do not exclude liability for fraud, death, or injury caused by our negligence.
12. General Terms
12.1–12.2 Certain clauses remain in force after termination. Each hire is a separate contract.
12.3–12.4* You are responsible for your agents and must indemnify us for losses from your breach.
12.5 No waiver of rights unless agreed in writing.
12.6 We are not liable for delays due to Force Majeure.
12.7 This agreement is governed by English law. Only you and we can enforce it, except any finance company involved with the goods.
